2. Data we process and purposes
Handling enquiries sent through the contact forms. This is currently the only processing of data relating to visitors to the Website.
Management of administrator access accounts: access serves solely for the administration of the Website by the owner and is not a visitor feature. The Website does not offer public user registration.
Sending commercial communications, only where the user has given consent.
Statistical and advertising analysis of the use of the Website, by means of cookies and third-party technologies subject to your consent (see the Cookie Policy).
3. Legal basis
Processing is based, as applicable, on the consent of the data subject, the performance of a contract or pre-contractual measures, and the legitimate interest of the controller.
4. Retention
We retain data for as long as necessary for the purpose for which it was collected and, thereafter, duly blocked, for the applicable statutory limitation periods:
Contact data / enquiries: until the enquiry is resolved and for a reasonable period thereafter.
Administrator access accounts: while the account remains active; after cancellation, they are deleted unless there is a legal obligation to retain them.
Billing data (where applicable): for the applicable tax and commercial law periods (up to 6 years).
Commercial consent: until the data subject withdraws their consent.
5. Recipients and processors
We do not disclose data to third parties except where legally required. Services are provided to us as processors, with the appropriate contractual safeguards, by our hosting provider (netcup GmbH, Germany) and, where applicable, by the analytics and advertising providers listed and kept up to date in the Cookie Policy.
6. Server location and international transfers
The servers hosting the Website are located in Germany. Where hosting takes place within the European Economic Area (EEA), the mere hosting of the data does not entail international transfers. However, some analytics and marketing providers (if active, according to the Cookie Policy) may process data on servers located outside the EEA, mainly in the USA. Such transfers rely on the safeguards provided for by the GDPR: standard contractual clauses approved by the European Commission and/or the provider’s adherence to the EU-US Data Privacy Framework. 7. Your rights
You may exercise the rights of access, rectification, erasure, portability, restriction and objection, as well as withdraw any consent given, by writing to info@5starstenerife.com and providing proof of your identity. The exercise of these rights is free of charge.
8. Complaint to the supervisory authority
If you consider that the processing does not comply with the applicable rules, you may lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos, www.aepd.es).
9. Minors
The Website is not directed at children under 14. We do not knowingly collect data from children under that age without the consent of those holding parental responsibility or guardianship. If we detect such processing, we will delete the data.
10. Commercial communications
We will only send commercial communications if you have given your consent. Every communication includes a simple and free way to unsubscribe (unsubscribe link or reply to info@5starstenerife.com).
