1. Purpose and acceptance

These terms govern access to and use of the website 5 Stars Tenerife (the “Website”). Browsing the Website confers the status of user (the “User”) and implies full acceptance of these terms as published at the relevant time.

The identification details of the owner of the Website are set out in the Legal Notice. The processing of personal data is described in the Privacy Policy and the Cookie Policy.

2. Relationship with the booking terms for our tours

These terms concern the use of the Website only. Booking, participation in and cancellation of our tours are governed by the General Terms and Conditions, which are a separate document. In the event of any discrepancy between the two texts in matters relating to bookings, the General Terms and Conditions prevail.

3. Permitted use

The User undertakes to use the Website in accordance with the law, these terms, good faith and public order. In particular, the User shall refrain from:

  • using the Website for unlawful purposes or in a way that harms the rights and interests of third parties;

  • introducing or distributing viruses or other programs capable of causing damage to the systems of the owner or of third parties;

  • attempting to access restricted areas, other users’ accounts or the systems supporting the Website, or circumventing its security measures;

  • using automated means of mass content extraction that may impair the operation of the Website;

  • impersonating another person or providing false information.

4. Access accounts

The Website does not offer public user registration. Access accounts are reserved for the administrators of the Website, and only an administrator may create further accounts. Anyone holding an account is responsible for safeguarding their credentials and for any activity carried out through it, and must notify us immediately of any unauthorised use.

5. Intellectual and industrial property

The content of the Website is protected as set out in the Legal Notice. Access to the Website does not grant the User any right of exploitation over that content beyond viewing it and the personal use necessary to browse the Website.

6. Links

The Website may contain links to third-party pages, over whose content and policies we exercise no control and for which we accept no responsibility. The presence of a link does not imply any relationship, recommendation or supervision.

Anyone wishing to link to the Website may do so to its home page, without reproducing its content, without creating confusion as to the origin of the service and without making inaccurate or disparaging statements about the owner.

7. Availability of the Website

We endeavour to keep the Website continuously accessible, but we do not guarantee uninterrupted availability or that it will be free of errors. We may temporarily suspend access for maintenance, security or update reasons, and we may modify or discontinue any of its content or functionality.

8. Liability

We are not liable for damage arising from use of the Website, including errors or omissions in the content, unavailability of the site or the transmission of malicious software, on the terms set out in the Legal Notice and within the limits established by applicable law. Nothing in these terms excludes or limits any liability that may not lawfully be excluded or limited in relation to consumers.

The processing of the User’s personal data is governed by the Privacy Policy. The use of cookies and similar technologies is described in the Cookie Policy, from which the User may manage and withdraw consent at any time.

10. Changes to these terms

We may amend these terms to reflect legal, technical or operational changes. The applicable version is the one published on the Website at the time of access, stating its date of update.

11. Governing law and jurisdiction

These terms are governed by Spanish law. The courts of Santa Cruz de Tenerife have jurisdiction, except where consumer legislation gives a User who is a consumer the right to bring proceedings before the courts of their own place of residence.

Accessing and browsing the Website implies knowledge and acceptance of these terms.
